Additional information in relation to 'Terms and Conditions of Use'

All capitalized terms used but not defined herein shall have the meaning assigned to such term under the Terms and Conditions of Use available on our website https://logisticsjunction.com/ (“Terms and Conditions of Use”). The terms and conditions set out below are in addition to the Terms and Conditions of Use, and shall be governed in accordance with the terms thereof. Further, the illustrations set out herein are only for information purposes and Logistics Junction shall not be liable for any discrepancies/changes as a result of any updates or modifications to the Portal or the Terms and Conditions of Use. The information contained in this page is subject to frequent updates and/or revisions by Logistics Junction, and Logistics Junction is not responsible to notify any person of any such updates/ revisions. . A. Demurrage Policies

1. For Loading.

   1. If Logistics Junction vehicle arrives at the point of unloading before 10 am and the goods are not fully unloaded from the vehicle by the consignee within 7 hours of arrival of the vehicle, demurrage charges will be applicable for delay of each day or part thereof, as per the Demurrage Charge Chart below.
   2. If Logistics Junction vehicle arrives at the point of unloading after 10 am and the goods are not fully unloaded from the vehicle by the consignee within 24 hours of arrival of the vehicle, demurrage charges will be applicable for delay of each day or part thereof, as per the Demurrage Charge Chart below.

2. For Unloading.

   1. If Logistics Junction vehicle arrives at the point of loading before 2 pm and the goods are not loaded onto the vehicle and fully packed by the User within 10 hours of arrival of the vehicle, demurrage charges will be applicable for delay of each day or part thereof, as per the Demurrage Charge Chart below
   2. If Logistics Junction vehicle arrives at the point of loading after 2 pm and the goods are not loaded onto the vehicle and fully packed by the User within 24 hours of arrival of the vehicle, demurrage charges will be applicable for delay of each day or part thereof, as per the Demurrage Charge Chart below.

It is clarified that demurrage charges would be leviable upto a maximum of 5 days. For any further delays, Logistics Junction shall be entitled to exercise its rights in respect of “Forfeiture and Sale” and/or “Rejected Consignments” under the Terms and Conditions of Use.

Further, it may be noted that demurrage charges shall also be applicable when there is a delay in delivery due to the destination address provided by the User being incomplete, outdated or incorrect or where the directions provided by the User have caused such delay and Logistics Junction is subsequently unable to deliver the shipment to the desired location. Any extra travel would be chargeable as per the table set out below.

The above mentioned charges will be applicable on the same Booking-ID. Its amount will be blocked from the Logistics Junction Account and incase of insufficient funds, next booking will be allowed only once the entire amount for the prior booking is settled. In the event the concerned User does not have a Logistics Junction Account, no further bookings would be permitted till these amounts are paid, and Logistics Junction shall have the right to initiate appropriate proceedings for recovery of these amounts.

Separately, it may be noted that pursuant to Logistics Junction’s extant policies, prior to completion of a ‘Trip’ on Logistics Junction, the vehicle may be required to be taken to a weigh-bridge to ensure that the consignment is delivered without any pilferage. In this regard, it may be noted that:

1. In case a weigh bridge is not available at the loading or unloading point, the extra distance travelled by the vehicle for completing the process of weighment will be applicable on the same Booking-ID as per the table below and shall be payable at the same rates by the User as per the table below.
2. In case of a faulty weigh bridge at loading or unloading locations, the extra distance covered by the vehicle for cross-verification of weight of goods will be charged and will be applicable on the same Booking-ID as per the table below and shall be payable at the same rates by the User as per the table below.

B. Cancellation Policies (For Cancellation By User)

For cancellation by Users, the following cancellation charges will be levied by Logistics Junction:

1. The minimum cancellation charge will be applicable to all the bookings cancelled after 1 hour from the booking time.
2. When cancelled after 11 AM of the scheduled pick-up date, cancellation charges will be applicable as per the Cancellation Charges Chart below, along with the cost of distance travelled by vehicle as per the per km charge set out in the Cancellation Charges Chart below if the vehicle has already commenced its journey for the loading point at the time of cancellation.

Do note that 3% extra will be charged for cancellation of transactions that have been transacted through credit card or debit card.

In addition, as noted in the Terms and Conditions of Use, Logistics Junction will be entitled to take such measures as it may deem necessary to prevent misuse of the Portal by the User, including without limitation, downgrading of the User on the Portal, imposition of minimum security deposit prior to permitting the concerned User to avail any Service on the Portal, etc.

C. Policy for Penalty

In the event of a breach of the Terms and Conditions of Use, Users shall be liable to pay penalties as per the following particulars:

1. For soiling of the vehicle, the User will be liable to pay a penalty of upto Rs.2,000/-, at the discretion of Logistics Junction.
2. For any damage caused to the vehicle by the User, the User will be charged on actual estimate provided by the authorised workshop of the manufacturer of the vehicle, plus demurrage charges per day for the number of days the vehicle is out of operations due to undergoing repairs.
3. If a User forces a driver/ conductor to load any consignment on the vehicle, details of which are inconsistent with the details provided in respect of such booking on the Portal, Logistics Junction can, at its sole discretion, reject the Work Order and levy a penalty on the User amounting to the amount paid by the User in respect of such Work Order.
   

   If a User undertakes any action which causes Logistics Junction or the Service Provider to be in breach of any law, then, the penalty levied on Logistics Junction/ Service Provider will be recovered from the User at actual, amount paid by the User in respect of such Work Order shall be retained by Logistics Junction as penalty.

4. It would be considered a misuse of the vehicle if any laws are broken which is capable of incurring penalties. The penalty charged by Logistics Junction would cover the legal penalties by the Indian Law plus the exact total order value.
5. In the event of government penalties incurred by Logistics Junction on account of lack of documentation or tax irregularities of the User or delay due to such reasons during transit – the User shall be liable to bear the said penalties and demurrage charges due to such delay.

D. Cancellation Policy (for cancellation by Logistics Junction)

In the event of cancellation of Work Order by Logistics Junction, Logistics Junction would be liable to pay penalties as per the following table:
